Terms & Conditions

These Terms & Conditions (“Terms”) are an agreement between you and Loveability (“we”, “us”, “our”). They govern your use of the LoveAbility mobile application and the website at loveability.app (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy and Community Guidelines.

1. Your account

• You must provide accurate information and keep it up to date.
• You are responsible for your account and for keeping your password secure. Do not share your login with anyone.
• One account per person. Do not create accounts to evade a suspension or ban.
• You must not impersonate another person or misrepresent your identity.

2. Subscriptions and fees

LoveAbility is currently free to use. We may introduce paid features in the future. If we do, we will show the price and terms before you buy, and purchases made through the Apple App Store or Google Play are also subject to those stores’ terms.

3. Acceptable use

You agree not to:

• Harass, threaten, stalk, bully, or intimidate anyone, or encourage others to do so.
• Post hate speech or content that attacks people based on race, ethnicity, religion, disability, disease, gender, gender identity, sexual orientation, or any other protected characteristic.
• Post sexually explicit content, nudity, or content involving minors.
• Share another person’s private information, photos, or messages without their consent.
• Use the Services for spam, scams, solicitation, or commercial promotion without our permission.
• Collect other users’ information, scrape the Services, or use bots or automated tools.
• Upload malware, attempt to gain unauthorised access, or interfere with the Services.
• Break any applicable law, or violate another person’s rights.

4. Your content

• You keep ownership of the content you create, such as posts, photos, and messages.
• You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute your content only as needed to operate, provide, and improve the Services. This licence ends when you delete your content or account, except for copies kept in backups or as required by law.
• You are responsible for your content and confirm you have the rights to share it.
• We may remove content that violates these Terms or our Community Guidelines.

5. Avatars, photos, and consent

• You appear as your chosen avatar until you choose to reveal real photos.
• Only share photos you own or have permission to use, and never share someone else’s photos without their consent.
• Do not save, screenshot, or share another user’s photos or messages without their consent.

6. Moderation, reporting, and blocking

We want LoveAbility to be safe. You can report content or users and block people you do not want to interact with. We review reports and may remove content or take action against accounts. Read our Community Guidelines for details.

7. Suspension and termination

We may suspend or terminate your access if you violate these Terms or our Community Guidelines, or if we believe your use creates risk for other users or for us. You can stop using the Services and delete your account at any time. Sections that by their nature should survive termination will continue to apply.

8. Intellectual property

The Services, including the LoveAbility name, logo, design, and software, are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works except as allowed by these Terms or by law.

9. Third-party services and app stores

The Services rely on third parties such as Apple, Google, Supabase, SendGrid, OneSignal, and Firebase. Your use of the app may also be subject to the Apple App Store or Google Play terms. Apple and Google are not responsible for the Services or for supporting them.

10. Disclaimers

• The Services are provided “as is” and “as available”, without warranties of any kind to the extent permitted by law.
• We do not guarantee that you will match or connect with anyone, or that content posted by users is accurate.
• LoveAbility is a community platform, not a crisis or emergency service. If you are in danger or in crisis, contact local emergency services right away.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the past twelve months or USD 100.

12. Indemnification

You agree to indemnify and hold us harmless from claims and expenses arising out of your content, your use of the Services, or your violation of these Terms or the rights of others.

13. Governing law and disputes

These Terms are governed by the laws of the State of Arkansas, United States, without regard to conflict-of-law rules. Any dispute will be handled in the courts located there, unless mandatory local law gives you the right to bring a claim elsewhere.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email and update the date above. Continued use of the Services means you accept the revised Terms.
